No, RCA insurance covers personal injury or damage to property suffered by someone other than the driver of the insured vehicle.

What costs are indemnified under the terms and conditions of the RCA insurance:

  • For bodily injury or death, including moral damages;
  • damage to property, including the cost of scrapping the vehicle and the cost of mitigating the damage;
  • costs relating to the repair of the vehicle, as proved by documents issued by the repair units or by documents issued under the terms of this law;
  • legal costs incurred by the injured party in civil proceedings or costs of alternative dispute settlement, if the settlement is favorable to the injured party;
  • the cost of one single removal of the damaged vehicle belonging to the injured party from the place of the accident to the location of the claims representative or to the repair establishment chosen by the injured party for the purpose of repairing the vehicle, or to the nearest location to the place of the accident or to the residence of the injured party, as the case may be, if the vehicle is no longer capable of moving by his own means or if its movement may endanger road traffic safety.

RCA insurance in the Republic of Moldova provides coverage for the legal liability of the vehicle owner towards third parties arising out of the use of the insured vehicle within the following established limits:

  • EUR 100 000 for property damage in case of destruction of or damage to property;
  • EUR 100 000 per person for bodily injury or death;
  • 500 000 euro - total limit per case for personal injury or death;
  • 5 000 euro per person for non-material damage due to disability or death;
  • 10 000 euro - the total limit per case for moral damages due to disability or death.

Insured cases are considered to be accidents caused by a motor vehicle whose owner and/or user has fulfilled the obligation of RCA insurance, resulting in damage:

  • both while the vehicle is in motion and while stationary;
  • the accidental detachment, while the vehicle is in motion, of trailers, semi-trailers or attachments;
  • from devices or installations with which the vehicle has been equipped;
  • as a result of the accidental spillage, spillage or fall of substances, materials or articles being transported;
  • when entering or leaving the vehicle.

The insurance premium is calculated on the basis of the basic insurance premium, to which are applied the established correction coefficients and the bonus-malus system.

With the partial deregulation of MTPL premiums, the price of an MTPL policy for vehicles and policyholders meeting the same criteria will no longer be the same for all insurers. It will be set by insurers on the basis of the risks specific to their own MTPL portfolios. During the period of partial liberalization, insurers will calculate and apply MTPL insurance premiums based on a single methodology established by the supervisory authority (National Bank of Moldova), as well as a minimum level of MTPL insurance premiums in line with the reference premiums.

Any discounts not established by law are prohibited.

For individuals there is the Bonus-Malus system which influences the final premium paid. Under this system, people who have taken out MTPL insurance in previous years and have not caused any road accidents benefit from discounts ranging from 5% to 50%.

The Bonus-Malus system places the insured in one of the bonus classes (leading to a reduction in the insurance premium) or in one of the malus classes (leading to an increase in the insurance premium) depending on the insured's history during the reference period.

The essence of the system is that the insured is penalized when they have an accident - by paying a higher premium at renewal, while drivers without any incidents will benefit from discounts. The maximum penalty has the effect of doubling the normal price for an MTPL policy, while the maximum discount is 50% of the standard rate.

The principle of the Bonus-Malus system is as follows: the person (identified by IDNP) wishing to take out a MTPL policy is checked against the contract database. If in the last 12 months the person has been party to an MTPL insurance contract both as an insured and as an admitted driver, the Bonus-Malus class assigned to him/her is extracted from that contract. The person is then checked against the claims records database. If, in the last year, the person has not been involved in any road accidents for which insurance compensation has been paid, he or she will be assigned the next higher class than the initial one and will receive a 5% reduction in the calculation of the MTPL premium. The reduction can go up to a maximum of 50% within 10 years, provided that the insured person has not committed any road accidents with damages paid by insurers during these 10 years.

If we have the reverse situation, where during the validity period of the last MTPL insurance contract, the person has caused road accidents with damages paid out, the premium increase is applied according to the following method: for one accident in the last 12 months the premium increases by 10%, for two accidents in the same period by 20% and doubles if the insured has caused 4 or more accidents during the previous year.

In the situation of a road accident there are 2 possible courses of action:

  1. Amicable settlement - a simplified procedure in which the parties involved fix the details of the accident and its circumstances without involving the authorities.
  2. A police report is necessary when the law does not allow the amicable report mentioned in the above paragraph.
  1. The accident occurred on the territory of the Republic of Moldova.
  2. The accident involved 2 vehicles (both with valid MTPL policies).
  3. The accident resulted in insignificant damage (up to 15,000 lei).
  4. There were no injuries or damage to property other than the vehicles involved in the accident.
  5. Both drivers involved in the accident agree to the amicable settlement procedure and to all the circumstances mentioned in the form drawn up and signed by the parties, which means acceptance of the claim by one of the parties involved in the accident.
  6. The parties have the opportunity to photograph and/or film the vehicles involved in the accident and the damage caused.

Within 2 working days of the date of the accident, the injured party must submit the claim to the insurer of the person at fault, enclosing the "amicable settlement of accident" form.

A police-involved finding involves notifying the road accident by calling 112 and then going to the relevant police station. In this case, all the legal indications of the authorities and the classic procedure must be followed.

Advantages of an amicable settlement

The procedure for an out-of-court settlement simplifies the procedure associated with road accidents, which is often lengthy and cumbersome in general road accident situations. Thus, an amicable settlement exempts the parties from:

  1. going to the police station within whose radius the road accident occurred;
  2. Waiting for the police to document the accident and draw up the accident report;
  3. Medical examination to determine the state of drunkenness and its nature;
  4. The administrative sanction (both fine and suspension of driving license).

In the Republic of Moldova, the electronic MTPL insurance policy is fully valid and recognized by the authorities. According to national legislation, electronic signature is not mandatory for policies issued digitally, and payment of the insurance premium confirms consent to the conclusion of the contract.

According to art. 8, point 1 of Law no. 106 of April 21, 2004-2022 on compulsory motor third party liability insurance for damage caused by vehicles, it is stipulated that the MTPL insurance policy shall be issued on paper and/or by electronic means, in accordance with the normative acts of the supervisory authority. This means that the policy can be presented directly from your phone or other mobile device in the event of a check or accident.
